Terms of Service — AI Brand Visibility Audit

These Terms of Service govern your use of the AI Brand Visibility Audit service operated by WebSight Design, Inc. ("WebSight Design," "we," "us," or "our") at visibility.websightdesign.ai. By accessing or using the service, you agree to be bound by these terms.

1. Description of Service

The AI Brand Visibility Audit is a subscription-based service that analyzes how your brand is represented across leading AI platforms, including ChatGPT, Claude, Google Gemini, and Perplexity. The service delivers scored audit reports, actionable recommendations, and an ongoing visibility portal based on automated queries sent to these platforms.

2. Eligibility and Account

You must be at least 18 years of age and have authority to enter into a binding agreement on behalf of yourself or the business you represent. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

3. Subscription and Payment

Access to the service requires a paid subscription. All subscriptions are billed monthly in advance. Prices are listed at the time of purchase and are subject to change with reasonable notice. Payments are processed securely through Stripe. You authorize us to charge your payment method on a recurring basis until you cancel.

No refunds are issued for partial billing periods. If you cancel, your access continues through the end of the current paid period.

4. Free Audit

We may offer a one-time complimentary audit without a subscription. Free audits are limited to a single report and do not include portal access, trend tracking, or recurring scans. We reserve the right to modify or discontinue the free audit offer at any time.

5. Acceptable Use

You agree to use the service only for lawful purposes and in accordance with these terms. You may not:

Resell, sublicense, or redistribute the service or its outputs without written permission
Use automated tools to scrape, extract, or reproduce service content at scale
Attempt to reverse-engineer, interfere with, or disrupt the service or its infrastructure
Submit false or misleading brand information to manipulate audit results

6. Audit Results and Accuracy

Audit results reflect the responses generated by third-party AI platforms at the time the audit is run. These platforms are independent of WebSight Design, and their outputs may vary due to model updates, training data changes, or retrieval behavior. We make no guarantee that audit scores are definitive measures of brand performance and recommend treating them as directional indicators rather than absolute benchmarks.

7. Intellectual Property

All software, templates, scoring methodologies, and design elements of the service are the intellectual property of WebSight Design, Inc. Audit reports generated for your brand are licensed to you for your internal business use. You may not publish, redistribute, or commercialize report content without written consent.

8. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or produce any specific business outcome. AI platform responses used in audits are generated by third parties and are beyond our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, WebSight Design, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising from your use of or inability to use the service, even if advised of the possibility of such damages. Our total liability for any claim shall not exceed the amount you paid to us in the three months preceding the claim.

10. Termination

You may cancel your subscription at any time through your account or by contacting us. We reserve the right to suspend or terminate your account if you violate these terms, with or without notice. Upon termination, your access to the portal and stored reports will cease at the end of the current billing period.

11. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or by posting a notice on the site. Continued use of the service after changes take effect constitutes acceptance of the updated terms.

12. Governing Law

These terms are governed by the laws of the State of California without regard to conflict of law principles. Any disputes shall be resolved in the courts of Marin County, California.
